Consecrated women religious have been shown to be at increased risk for uterine and ovarian cancers. The authors critique a proposal by Kara Britt and Roger Short advocating the distribution of a combined oral contraceptive to women religious as a way of reducing this risk. The authors argue that the proposal is seriously flawed: the data it references attenuate its conclusion, the execution protocol is incomplete, and the proposal fails to address the serious health risks of combined oral contraceptives. In this commentary, we discuss Tom Cochrane’s theory of emotions. Cochrane offers an appealingly unified account of valent representations, ranging from simple responses to complex representations within a mechanistic framework. This offers some guidance as to how we might conceive of emotions as simple action-guiding responses in infants and animals, as well as context-sensitive evaluative states. While Cochrane argues for the centrality of bodily feelings, he does not consider his approach to be embodied in the narrower sense. We question his (...) reasons and suggest to think of emotions as embodied action-oriented representations. We, furthermore, suggest developing the approach with regard to the multiple roles that social norms play, and delve further into the nuanced relationship between bodily self-regulation and the formative influence of social norms on emotions. Indigenous communities have always cultivated social studies learning that is interactive, dynamic, and integrated with traditional knowledges. To confront the assimilative and deculturalizing education that accompanied European settlement of the Americas, Montana has adopted Indian Education for All (IEFA). This case study evaluates the Digital Storywork Partnership (DSP), which strives to advance the goals of IEFA within and beyond the social studies classroom through community-centered research and filmmaking. Results demonstrate the potential for DSP projects to advance culturally revitalizing education, community (...) connectedness, and identity-development. The DSP offers a model for social studies education that is not only culturally affirming and revitalizing for Indigenous communities, but also holds potential for use in all communities. We conclude with recommendations for educators, scholars, and community members engaged in similar efforts. (shrink)

This chapter argues that Hume's views on the nature and sources of virtue are pluralistic. He has a pluralistic account of the sources of the moral sentiment, the taxonomy of virtue, and most importantly, the criteria of virtue. The chapter also argues that his views are neither utilitarian in particular nor consequentialist in general, but comprise overlooked but significant non‐consequentialist features, gleaned particularly from Book II of the Treatise (Of the Passions), and which are characteristic of virtue ethics in general. The chapter discusses three broad categories of “species” or “appearance” which make a trait “naturally fitted” to be regarded as a virtue. Discussions also include indirect passion of pride. This paper examines college athletes’ perceived support for concussion reporting from coaches and teammates and its variation by year-in-school, finding significant differences in perceived coach support. It also examines the effects of perceived coach support on concussion reporting behaviors, finding that greater perceived coach support is associated with fewer undiagnosed concussions and returning to play while symptomatic less frequently in the two weeks preceding the survey. Coaches play a critical role in athlete concussion reporting.

In this article, I demonstrate that Simone de Beauvoir’s philosophy represents a first major step toward a rejection of the humanist subject and therefore was influential for the development of contemporary posthumanist material feminism. Specifically, her unprecedented attention to embodiment and biology, in The Second Sex and other works, as well as her notion of ambiguity, serve to challenge the humanist subject. While I am not claiming that Beauvoir was a posthumanist or material feminist thinker avant la lettre, I show (...) that she is an important precursor to some of their key ideas. Indeed, her thinking about the body, sex, gender, and the importance of embodiment and situation constitutes a challenge to the subject of humanism, thereby opening up a path for thinkers that follow to push Beauvoir’s critique and articulate a posthumanism that does away with the subject of humanism. It has now become a realistic prospect for smart care to be provided at home for those living with long-term conditions such as dementia. In the contemporary smart care scenario, homes are fitted with an array of sensors for remote monitoring providing data that feed into intelligent systems developed to highlight concerning patterns of behaviour or physiological measurements and to alert healthcare professionals to the need for action. This paper explores some ethical issues that may arise within such smart care (...) systems, focusing on the extent to which ethical issues can be addressed at the system design stage. Artificial intelligence has been widely portrayed as an ethically risky technology, posing challenges for privacy and human autonomy and with the potential to introduce and exacerbate bias and inequality. While broad principles for ethical artificial intelligence have become established, the mechanisms for governing ethical artificial intelligence are still evolving. In healthcare settings the implementation of smart technologies falls within the existing frameworks for ethical review and governance. Feeding into this ethical review there are many practical steps that designers can take to build ethical considerations into the technology. After exploring the pre-emptive steps that can be taken in design and governance to provide for an ethical smart care system, the paper reviews the potential for further ethical challenges to arise within the everyday implementation of smart care systems in the context of dementia, despite the best efforts of all concerned to pre-empt them. The paper concludes with an exploration of the dilemmas that may thus face healthcare professionals involved in implementing this kind of smart care and with a call for further research to explore ethical dimensions of smart care both in terms of general principles and lived experience. Access to surrogacy is often cast in the language of rights. Here, I examine what form such a right could take. I distinguish between surrogacy as a right to assisted procreation, and surrogacy as a contractual right. I find the first interpretation implausible: it would give rise to claims against the state that no state can fulfil, namely the provision of sufficient surrogates to satisfy the need. Instead, I argue that the right to surrogacy can only be plausibly understood as (...) a contractual right. I then investigate two different sets of harms that are often employed to argue against such a contractual interpretation of the right to surrogacy: harm to women's interests in a gendered society, and harm to the sense of self of the surrogate. I assess both of these through the analytical lens of vulnerability. I find neither of them to be convincing arguments against surrogacy contracts. In conclusion, I agree that surrogacy contracts should be carefully regulated, but I disagree with those who call for prohibition of the right to surrogacy as a contractual right. (shrink)

One of the defining features of the capability approach to health, as developed in Venkatapuram's book Health Justice, is its aim to enable individual health agency. Furthermore, the CA to health hopes to provide a strong guideline for assessing the health-enabling content of social and political conditions. In this article, I employ the recent literature on the liberal concept of vulnerability to assess the CA. I distinguish two kinds of vulnerability. Considering circumstantial vulnerability, I argue that liberal accounts of vulnerability (...) concerned with individual autonomy, align with the CA to health. Individuals should, as far as possible, be able to make health-enabling decisions about their lives, and their capability to do so should certainly not be hindered by public policy. The CA to health and a vulnerability-based analysis then work alongside to define moral responsibilities and designate those who hold them. Both approaches demand social policy to address circumstances that hinder individuals from taking health-enabling decisions. A background condition of vulnerability, on the other hand, even though it hampers the capability for health, does not warrant the strong moral claim proposed by the CA to health to define health as a meta-capability that should guide social policy. Nothing in our designing social policy could change the challenge to health agency when we deal with background conditions of vulnerability. (shrink)

A well-trod debate at the nexus of cognitive science and linguistics, the so-called past tense debate, has examined how rules and exceptions are individually acquired. However, this debate focuses primarily on individual mechanisms in learning, saying little about how rules and exceptions function from a sociolinguistic perspective. To remedy this, we use agent-based models to examine how rules and exceptions function across populations. We expand on earlier work by considering how repeated interaction and cultural transmission across speakers affects the dynamics (...) of rules and exceptions in language, measuring linguistic outcomes within a social system rather than focusing individual learning outcomes. We consider how population turnover and growth effect linguistic rule dynamics in large and small populations, showing that this method has considerable potential particularly in probing the mechanisms underlying the linguistic niche hypothesis. International migration has a female face in the beginning of the twenty-first century; since at least 1990, a total of 49 percent of international migrants have been women (UN 2008).1 Many women relocate in pursuit of goals that they can’t realize in their countries of origin, and many women move on their own to developed countries as caregivers to the very old or the very young, as nurses to attend to the sick in hospitals, and as domestic workers.2 How should (...) we regard their decisions to do so? Ever since the publication of G. A. Cohen’s essay “If You’re an Egalitarian, How Come You’re So Rich?” the matter of personal responsibility for the amelioration of economic disadvantage has become a question for egalitarian political philosophers to wrestle with both theoretically and personally. This essay examines “the demands of equality” in light of an egalitarian philosophy that focuses on human flourishing. I consider Cohen’s call for personal commitments to the egalitarian project to show both the power and problems of (...) his approach and propose an alternative view, where individuals’ concern for living well involves an engagement with the demands of equality, but also some respite from its strictures. Liberals are concerned with the equal moral status of all human beings. This article discusses what flows from this premise for moral cosmopolitans when analysing temporary foreign worker programs for low-skilled workers. Some have hailed these programs as a tool to achieve redistributive global goals. However, I argue that in the example of Live-In-Caregivers in Canada, the morally most problematic aspect is that it provokes vulnerability of individual workers. Once in a situation of vulnerability, important conditions of individual autonomy are (...) jeopardized. Even if these programs provide for redistribution of opportunities on a global scale, the challenge such programs pose to the conditions of autonomy can not outweigh these gains. Instead, they need to be re-assessed and changed to fundamentally express equal moral status of all human beings. (shrink)

Concussion is a form of traumatic brain injury that has been defined as a “trauma-induced alteration in mental status that may or may not involve loss of consciousness.” Terms such as getting a “ding” or getting your “bell rung” are sometimes used as colloquialisms for concussion, but inappropriately downplay the seriousness of the injury. It is estimated that between 1.6 and 3.8 million concussions occur annually in the United States as a result of participation in sports or recreational activities. To (...) date, there are no objective, biological markers for concussion; rather, the current diagnosis of concussion is dependent upon symptom reporting by the athlete. In the acute phase, concussions can result in a broad spectrum of symptoms that can be transient or last for days, weeks, or even months. State concussion laws and sport-league policies are important tools for protecting public health, but also present implementation challenges. Both state laws and league policies often require athletes provide written acknowledgement of having received concussion-related information and/or of their responsibility to report concussion-related symptoms. This paper examines these requirements in two ways: an analysis of the variation in state laws and sport-league policies and a study of their effects in a cohort of collegiate football players.

The idea of dignity is often taken to be a foundation for principles of justice and democracy. In the West it has numerous formulations and conceptualisations. Within the capabilities approach to justice theorists have expanded the concept of dignity to encompass animals and ecological communities. In this article I rework the idea of dignity to include the Māori philosophical concepts of Mauri, tapu and mana – something I argue is necessary if the capabilities approach is to decolonise in the Aotearoa (...) context. Furthermore, the article links the nation’s recognition of three extensive geographical regions – Te Awa Tupua, Te Urewera and Mt Taranaki – as legal persons to Mātauranga Māori and nonhuman dignity. In doing so, I identify the potential that this understanding of dignity and these legal moves have to decolonise democracy within the settler state. (shrink)

The paper draws its inspiration from the provocation which Merton offered sociology both to engage with empirical data and to perform analyses adequate to guide intervention beyond the particular case. Whilst contemporary STS is very different both in its models of theory and its forms of methodology, this paper suggests Merton's concerns with engagement and adequacy provide a useful way to interrogate current approaches. Specifically, the paper explores some recent anthropological conceptions of ethnographic fieldwork that have provided potent models for (...) the study of scientific and technological cultures. These multi-sited approaches have also provided the opportunity to develop new notions of intervention and explore alternative ways of making contributions to development of theory and practice. In the process of pursuing the goals of engagement and adequacy notions of ethnography have however become stretched. This sense of detachment from methodological canons accentuates the need for methodological debate and skill-sharing in STS. (shrink)

This chapter provides a response dependence interpretation of it, and shows that it is compatible with a virtue ethical interpretation of Hume's moral philosophy. It aims to do justice to Hume's convictions both that sentiment lies at the foundations of ethics, and that ethics is a form of reliable, objective interaction with the world, permitting critical purchase on both people's behavior and emotions through objectively and socially accessible notions of virtue and vice. The distinction between a scientific constitution of properties (...) and an ethical or aesthetic one is nicely illustrated with Hume's discussion of the beauty of a circle. The chapter discusses the analysis of Hume's notion of the moral sense itself. The moral sense, as an appreciation of virtue, involves sensitivities due to the excitement of “sympathy” but a sympathy driven by or operating within the background of desires for the good of others. Many critiques of consumerism inadequately consider the complex interactions between individuals, their desires, and their social practices. Christine Darr provides an analysis of desire within consumer culture by integrating insights from moral theology and sociology and offers intellectual resources for more deliberate decision-making.

A highly controversial issue in criminal law theory has been the use of strict liability offenses, i.e., offenses which create liability ‘without fault.’ The collection of strict liability offenses is varied according to the element of the particular offense with respect to which liability is strict. For example, a statute prohibiting the filing of a false financial statement with the Secretary of State might impose liability despite a reasonable error as to the truth of the statement, or as to the (...) financial nature of the statement, or as to the identity of the official in question. What all strict liability offenses have in common is the imposition of liability despite the possibility of reasonable mistake or due care regarding some important element of the offense. Generally, then, a strict liability offense is one to which a claim of no-negligence is not a defense. Indeed, such a claim will not even be heard. All that the prosecution need prove is the voluntary commission of the proscribed acts by the defendant; no other question concerning the defendant's efforts or opportunity to obey the law is relevant to liability or conviction. This chapter elaborates the psychology of Nietzsche's motif of escape from self with the help of the views of Alfred Adler, Erich Fromm, and Karen Horney. It summarizes the root cause of failure of self‐love on this Nietzschean psychology. The chapter also focuses on four major types of distortion, which provide the main themes of the Genealogy of Morals. These are the perversion of cruelty, the neurosis of cruel punitivism, the neurosis of resentment, and the resignatory neurosis of the ascetic (...) ideal. In all four areas, virtue can be understood as having at its core self‐affirmation or self‐love, and vice self‐hate and escape from self. That is, at a depth psychological level, virtue can be seen as expressive of a self‐loving attitude and vice the reverse. The existentialist motif of escape from self has in Nietzsche's hands been transformed into a characterological psychology at home in virtue ethics. (shrink)
